Terms of Service

1. Services

By enrolling, you are purchasing a recurring fitness coaching membership, which may include in-person personal training, semi-private training, online programming, and app-based coaching support delivered through the Trainerize platform. Services provided depend on the membership selected at enrollment.

2. Billing & Automatic Renewal

All memberships are billed on a recurring basis according to the frequency specified at checkout (e.g., monthly or every four weeks). Memberships automatically renew at the end of each billing cycle unless canceled in accordance with the cancellation policy below. By completing your purchase, you authorize recurring charges to your selected payment method.

3. Pricing & Periodic Adjustments

Membership rates are set at the price selected at enrollment and reflect the current scope of services provided.

To ensure continued quality of coaching and support, pricing may be reviewed periodically. Any rate adjustments will be made no more than once per year and will be communicated in writing at least 30 days in advance.

4. Commitment Terms & Early Termination Policy (If Applicable)

By enrolling in any recurring coaching plan or membership, you agree to the following commitment terms:

  • 4.1 Minimum Term: You are committed to the full duration of the specific plan selected at the time of purchase. The length of this commitment (e.g., 12-month, 18-month, etc.) is clearly disclosed in the Product Name or Payment Link description reviewed prior to checkout.

  • 4.2 Early Termination Fee: If you request to cancel your plan before completing the specified minimum term, a one-time Early Termination Fee will apply. This fee is equal to one (1) full month of your current membership rate at the time of cancellation. Payment of this fee satisfies the remaining commitment obligation.

  • 4.3 Authorization: By completing your purchase, you explicitly authorize Joseph Zen dba Cityzen In Motion to charge your payment method on file for this one-time Early Termination Fee upon your request to terminate the agreement early.

  • 4.4 No Proration: Early Termination Fees are non-refundable and will not be prorated.

5. Cancellation Policy

Memberships may be canceled at any time by providing written notice at least seven (7) days prior to the next billing date.

For month-to-month memberships, cancellation will take effect at the end of the current billing cycle. For commitment-based memberships, early cancellation will trigger the early termination fee described in Section 4.

Cancellation requests submitted after the billing date will take effect the following billing cycle. No partial refunds are issued for unused sessions, services, or time within a billing period.

Cancellation requests must be submitted in writing via email or Trainerize/text message.

6. Session Scheduling

Training sessions are scheduled in advance and subject to availability. Session frequency is based on the membership selected.

Membership fees are based on reserved training availability, not solely on sessions attended.

7. Cancellations, Missed Sessions & Make-Up Policy

  • 24-Hour Notice: Sessions canceled with less than 24 hours’ notice are forfeited and not eligible for make-up.

  • Rescheduling: If a session is canceled with at least twenty-four (24) hours’ notice, the session may be eligible for rescheduling within the same calendar week, subject to trainer availability. Same-week rescheduling is not guaranteed.

  • Make-Up Credit: If a same-week reschedule is not available, members may be granted one (1) make-up credit per billing cycle. Make-up credits must be used within thirty (30) days of the original session date or they will be forfeited. Make-up credits do not roll over or accumulate beyond the billing cycle.

  • No-Shows: Failure to appear for a session without notice ("No-Show") results in immediate forfeiture of the session.

8. Semi-Private & Group Training Policies

Semi-private and group memberships are structured around shared sessions:

  • Sessions are attended together by the registered participants.

  • Sessions are not interchangeable with one-on-one training.

  • If one participant is unable to attend, the session still counts as scheduled.

  • Billing responsibility remains with the primary account holder if billed to a single account.

9. Membership Pauses & Holds

Temporary membership pauses may be requested for travel, illness, injury, or personal circumstances. All pauses must be requested in advance and approved in writing.

  • Approved pauses are granted for up to 30 days. At the end of the approved pause period, the membership will automatically resume and regular billing will restart.

  • Extended pauses beyond 30 days may be approved on a case-by-case basis.

10. Refund Policy

All payments are non-refundable once processed, except where required by California law.

11. Promotional Sessions & Credits

Complimentary, bonus, or referral sessions are non-refundable and non-transferable. These sessions are intended to be used during the active term of coaching. Should the agreement be terminated by the Client for any reason, all outstanding promotional credits will expire on the final date of service and cannot be redeemed for cash or used to offset final payments.

12. Health & Safety

You acknowledge that participation in fitness training involves physical activity and inherent risks. You confirm that you are physically able to participate and agree to disclose any injuries, medical conditions, or limitations prior to training.

Participation is voluntary and at your own risk.

13. Communication

By enrolling, you consent to receive communications related to training, scheduling, and billing via email, text message, or the Trainerize app.

14. Changes to Terms

These Terms & Conditions may be updated periodically. Continued participation in services after any updates constitutes acceptance of the revised terms.

15. Governing Law

These Terms & Conditions are governed by the laws of the State of California.
